1. Acceptance of Terms

By accessing or using Eiryn ("the App"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and Eiryn ("we", "us", or "our").

2. Description of Service

Eiryn is an AI-powered image generation mobile application that allows users to:

• Create artwork by entering text descriptions
• Choose from 12 different artistic styles
• Organize created artworks into projects
• Track creative statistics and unlock achievements
• Save and manage generated images locally on their device

The App uses third-party AI technology to generate images based on user-provided text prompts.

3. Eligibility and Account

3.1 Age Requirements

The App is rated 17+ and is intended for users aged 17 and older. By using the App, you represent and warrant that you are at least 17 years of age. If you are under 17, you are not permitted to use the App.

3.2 Account Usage

The App does not require user registration or account creation. All data is stored locally on your device. You are responsible for:

• Maintaining the security of your device
• All activities that occur on your device
• Backing up your data (we do not provide cloud backup services)

4. User Conduct and Prohibited Uses

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• To create content that infringes on the intellectual property rights of others
• To generate content depicting minors in inappropriate situations
• To create deepfakes or misleading content intended to deceive others
• To impersonate any person or entity
• To engage in any activity that could harm, disable, or impair the App's functionality

4.2 Content Restrictions

You must not use the App to generate:

• Pornographic, sexually explicit, or adult content
• Content promoting violence, hate speech, or discrimination
• Content that violates privacy rights or publicity rights
• Content for illegal activities or purposes
• Spam, malware, or other malicious content

5. Intellectual Property Rights

5.1 App Ownership

The App and its original content, features, and functionality are owned by Eiryn and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 User-Generated Content

You retain ownership of the images you generate using the App. However, you acknowledge that:

• The images are created using AI technology provided by third-party services
• You are solely responsible for how you use the generated images
• You must comply with applicable copyright and intellectual property laws when using generated images
• We do not claim ownership of your generated images
• We do not monitor or review the content you generate

5.3 License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

6. AI-Generated Content Disclaimer

You acknowledge and agree that:

• No Guarantee of Accuracy: AI-generated images may contain errors, inaccuracies, or unexpected results
• No Content Review: We do not review, approve, or endorse any user-generated content
• Third-Party Technology: Image generation relies on third-party AI services that we do not control
• Unpredictable Results: AI may produce unexpected or unintended results based on your prompts
• No Warranty: We make no warranties about the quality, accuracy, or suitability of generated images

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Key points:

• All artworks are stored locally on your device
• Text prompts are sent to third-party AI services for image generation
• We do not collect personal identification information
• You can delete all data by deleting your account or uninstalling the App

8. Third-Party Services

The App uses third-party AI image generation services to create artwork. These services:

• Operate under their own terms of service and privacy policies
• May have their own content restrictions and usage policies
• Are not controlled or endorsed by us

We are not responsible for the availability, accuracy, or reliability of third-party services.

9. Fees and Payments

The current version of Eiryn (1.0.0) is provided free of charge with no in-app purchases. We reserve the right to introduce paid features, subscriptions, or in-app purchases in future versions. Any such changes will be communicated to users in advance.

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the quality, accuracy, or reliability of AI-generated content

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from AI-generated content
• Unauthorized access to or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO USE THE APP (CURRENTLY $0).

11. Indemnification

You agree to indemnify, defend, and hold harmless Eiryn, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you generate using the App
• Your use of AI-generated images

12. Modifications to the App and Terms

12.1 App Modifications

We reserve the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Add or remove features
• Change pricing (with advance notice)
• Update the App to comply with legal requirements

12.2 Terms Modifications

We may revise these Terms at any time. When we do:

• We will update the "Last Updated" date
• We will notify you through the App or via email (if applicable)
• Your continued use constitutes acceptance of the revised Terms
• If you don't agree to the changes, you must stop using the App

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

• Deleting your account within the App (Profile > Settings > Delete Account)
• Uninstalling the App from your device

13.2 Termination by Us

We reserve the right to terminate or suspend your access to the App immediately, without notice, if:

• You violate these Terms
• You engage in prohibited activities
• Required by law or regulatory authority
• We discontinue the App

13.3 Effect of Termination

Upon termination:

• Your right to use the App will cease immediately
• All locally stored data will remain on your device until you delete it
• Provisions that by their nature should survive (including indemnification and limitation of liability) will survive termination

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

14.2 Informal Resolution

If you have any dispute with us, you agree to first contact us at support@eiryn.com and attempt to resolve the dispute informally for at least 30 days before initiating any legal proceedings.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eiryn regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.
